How Privaata is delivered as an online SaaS service after account activation and subscription setup.

Privaata Digital Service Delivery Policy

This Digital Service Delivery Policy (“Policy”) explains how Privaata, a software-as-a-service platform operated by Kinfolk Technologies Limited (“Kinfolk Technologies,” “we,” “us,” or “our”), is delivered to customers following registration, commencement of a free trial, or purchase of a paid subscription.
Because Privaata is a digital software service, no physical goods are shipped or delivered in connection with a standard Privaata subscription.
1. Nature of the Service
Privaata is a cloud-based privacy management software platform delivered electronically over the internet.
Customers access Privaata through a supported web browser and an authorized Privaata account or organizational workspace.
Privaata does not ordinarily require delivery of physical media, equipment, printed materials or other physical products.
Accordingly, traditional shipping, courier, freight, collection and physical delivery terms do not apply to Privaata subscriptions.
2. Electronic Delivery
Delivery of Privaata occurs electronically by providing the Customer with access to the Privaata platform and the features included in the Customer’s applicable subscription or trial.
Access may require the Customer to:
complete account registration;
provide required organization information;
verify an email address where required;
establish authentication credentials;
provide a valid payment method where required;
accept applicable contractual terms; and
complete any other reasonable account-security or onboarding requirements.
Once the applicable requirements have been successfully completed, access will ordinarily be provided electronically.
3. Seven-Day Free Trial
Eligible Customers may receive a seven-day free trial of Privaata.
A valid payment method is required to begin the trial.
Subject to successful account registration, payment-method setup and any required email verification, trial access will ordinarily be activated immediately.
No physical delivery is required.
Unless cancelled before the end of the seven-day trial, the trial will automatically convert to the Customer’s selected paid monthly or annual subscription in accordance with the Privaata Refund & Cancellation Policy and Terms of Service.
4. Conversion From Trial to Paid Subscription
Where a free trial automatically converts to a paid subscription, access to Privaata should ordinarily continue without interruption if the applicable subscription payment is successfully authorized.
The Customer does not need to receive or install a physical product for the paid service to begin.
The Customer’s account or workspace will continue under the features and limits associated with the selected paid subscription.
5. Direct Paid Subscriptions
Where Privaata permits a Customer to purchase a paid subscription without first completing a free trial, access will ordinarily be activated immediately following:
successful account setup;
completion of applicable verification requirements; and
successful authorization of the required payment.
Technical processing, fraud-prevention checks, payment-provider delays or account-verification requirements may occasionally delay activation.
6. What Constitutes Delivery
For purposes of a standard Privaata subscription, the service is considered electronically delivered when the Customer’s authorized account or workspace has been activated and the applicable Privaata functionality has been made available for access.
Electronic delivery does not require the Customer to use every available feature after activation.
Failure to use an activated subscription does not mean that the service was not delivered.
7. Subscription Features and Service Levels
The functionality delivered to each Customer depends on the subscription plan, trial, enterprise agreement or other applicable arrangement.
Plans may vary according to matters such as:
modules;
number of users;
number of legal entities;
AI usage allowances;
automation allowances;
integrations;
storage;
reporting functionality;
support level; and
other usage limits or features.
Electronic delivery of a subscription means delivery of the functionality included in the Customer’s applicable plan. It does not automatically entitle the Customer to functionality offered under another plan.
8. Enterprise Delivery and Onboarding
Enterprise Customers may require additional implementation activities before the service is fully operational.
These may include:
workspace configuration;
organizational onboarding;
user provisioning;
single sign-on configuration;
integration setup;
migration;
security review;
implementation assistance;
administrator training; or
other agreed deployment activities.
Accordingly, an enterprise agreement, order form, statement of work or other written arrangement may establish a specific activation date, implementation schedule or phased deployment.
Where such an agreement conflicts with this standard Policy concerning delivery timing, the applicable written enterprise arrangement will govern.
9. Third-Party Integrations
Certain Privaata functionality may depend on Customers connecting third-party systems.
Activation of the Privaata workspace itself does not necessarily mean that every optional third-party integration has been connected or synchronized.
Customers may need to separately authorize integrations and grant appropriate permissions.
Third-party authorization processes, API availability, administrative approvals and technical requirements may affect the time required to activate a particular integration.
10. Payment Authorization and Delivery
Where payment is required before paid access begins, activation is subject to successful payment authorization.
Payment may be processed through authorized third-party payment providers, financial institutions or payment networks.
A transaction may be delayed or declined for reasons outside Kinfolk Technologies’ direct control.
A submitted payment does not necessarily constitute a successful payment until the transaction has been appropriately authorized or confirmed.
11. Failed or Declined Payments
If a required payment fails or is declined, Kinfolk Technologies may:
delay initial activation;
notify the Customer;
request an updated payment method;
retry payment where appropriate and authorized;
provide a grace period;
restrict certain paid functionality; or
suspend access until the payment issue is resolved.
Any retry or recurring-payment activity will be handled in accordance with applicable payment arrangements, Customer authorization and the Privaata Refund & Cancellation Policy.
12. Delivery Confirmation
Customers may receive electronic confirmation relating to their Privaata purchase or activation.
Depending on the transaction and system configuration, this may include:
an account confirmation;
trial confirmation;
subscription confirmation;
electronic receipt;
invoice;
payment confirmation; or
other transaction information.
Customers should retain relevant transaction records for their records.
13. Problems Accessing the Service
If a Customer has successfully registered or paid for Privaata but cannot access the service, the Customer should contact Kinfolk Technologies promptly.

Customers should provide sufficient information to allow us to identify the relevant account and investigate the issue.
Customers should not send passwords, complete payment-card numbers, CVV/CVC security codes or other sensitive authentication credentials by email.
14. Activation Delays
Although Privaata is ordinarily delivered immediately for standard self-service subscriptions, occasional delays may occur because of:
payment processing;
email verification;
security checks;
suspected fraud;
technical failures;
account configuration;
third-party provider outages;
maintenance;
internet or network failures; or
other circumstances reasonably affecting activation.
Kinfolk Technologies will use reasonable efforts to investigate reported activation problems and provide access once applicable requirements have been satisfied.
15. Service Availability After Delivery
Electronic delivery or activation of Privaata does not constitute a guarantee that the platform will operate without interruption at all times.
Temporary interruptions may occur because of maintenance, upgrades, infrastructure failures, third-party service interruptions, cybersecurity events or other technical circumstances.
Service availability is governed by the Privaata Terms of Service and, where applicable, a separately negotiated enterprise Service Level Agreement (“SLA”).
16. Maintenance and Updates
Privaata is an online software service that may be updated periodically.
Kinfolk Technologies may deploy:
security updates;
bug fixes;
performance improvements;
new functionality;
interface changes;
infrastructure changes; and
other service updates.
Customers do not ordinarily need to receive replacement physical software when these updates occur.
Where reasonably practicable, Customers may receive notice of planned maintenance that is expected to materially affect service availability.
17. Customer Technical Requirements
Customers are responsible for maintaining the equipment and connectivity reasonably necessary to access Privaata, including:
a compatible device;
a supported web browser;
reliable internet connectivity; and
appropriate organizational network access.
A Customer’s inability to access Privaata because of its own device, internet connection, firewall, internal network configuration or unsupported software does not necessarily constitute a failure by Kinfolk Technologies to deliver the service.
Kinfolk Technologies will nevertheless provide reasonable support for legitimate access issues within the scope of the Customer’s applicable support arrangement.
18. Geographic Availability
Privaata is delivered online and may be offered to Customers in Jamaica and other supported jurisdictions.
Availability may nevertheless be subject to:
applicable laws and regulations;
sanctions or legal restrictions;
payment-provider availability;
currency support;
technical limitations;
contractual restrictions;
security considerations; and
Kinfolk Technologies’ commercial availability decisions.
Kinfolk Technologies does not represent that every Privaata feature, integration, payment method or service level will necessarily be available in every country.
19. Cancellation Does Not Constitute Delivery Failure
Where a Customer cancels an active paid subscription, the Customer will ordinarily continue to have access through the remainder of the current paid subscription period.
Cancellation prevents the applicable future renewal but does not mean that the service previously made available was not delivered.
Refund eligibility following cancellation is governed by the Privaata Refund & Cancellation Policy.
20. Digital Services and Returns
Because Privaata is a digital service, there is no physical product to return.
Accordingly, Customers do not need to ship, mail or physically return anything when cancelling Privaata.
Questions concerning refunds, accidental renewals, duplicate charges, billing errors or subscription cancellation are governed by the Privaata Refund & Cancellation Policy.
21. Customer Responsibility
Customers are responsible for providing accurate registration, billing and contact information necessary for delivery of the service.
Customers should ensure that:
the email address associated with the account is accessible;
authorized users can receive necessary account communications;
payment information is valid;
internal network restrictions permit appropriate access to Privaata; and
relevant administrators are available to complete integration or enterprise configuration where required.
Kinfolk Technologies is not responsible for delivery delays caused solely by inaccurate information supplied by the Customer or the Customer’s failure to complete required onboarding steps.
22. Relationship to Other Privaata Policies
This Policy should be read together with the:
Privaata Terms of Service;
Privaata Refund & Cancellation Policy;
Privaata Privacy Policy; and
any applicable enterprise agreement, order form or SLA.
If a separately executed enterprise agreement establishes different delivery or implementation obligations, that agreement will govern to the extent of the conflict.
23. Changes to This Policy
Kinfolk Technologies may update this Policy as Privaata’s delivery model, subscription structure, payment arrangements or functionality evolves.
The “Last Updated” date will identify the current version.
Where required by applicable law or contract, Kinfolk Technologies will provide reasonable notice of material changes.
